POUR ABSENCES RÉPÉTÉES: Remarques critiques des juges B. Domah et S. Bhaukaurally

Les juges Bushan Domah et Saheed Bhaukaurally, réagissant à des remarques de Me Anil Gayan (SC) sur les débats concernant l’absence à cinq reprises d’un jeune avocat au cours d’un procès d’appel, ont soutenu que les jeunes ne sont pas les seuls à blâmer. Ils ont souligné que ce sont les aînés qui ont donné le mauvais exemple. Ils s’attendent à ce que la réforme du judiciaire annoncée redonne son titre de noblesse à la profession d’avocat.
« With respect to the comment of M. Gayan SC, on the conduct of counsel whose state of health became the cause of five postponements, we do not have the explanation of the young counsel before us so that it would not be in order for us to make comments here in the absence of his version. Such matters have, in all fairness, to be dealt with another forum where we are minded to referring it. We consider it fitting to add, however, that we would hardly be surprised if young counsel came with the explanation that all he did, was to perfect the art which he had learned from others before him in a system which has been allowed to deteriorate. If everyone concerned was disposed to do his little bit so that the younger ones are properly guided, encouraged, assisted and informed, the titre de noblesse of the profession would be less likely to be travestied. We find comfort, though, in the fact that matters such as these will be taken on board more frontally with the reform the professions are now advocating so that the needy professionals, young and less young, may learn to learn the ignoble and relearn the noble », ont fait ressortir les deux juges.
Le procès en appel concerne les sentences infligées par la cour criminelle intermédiaire, que quatre appelants jugeaient excessives. Ayant commis un hold-up, ils avaient été condamnés pour vol avec des circonstances aggravantes. Dans leur jugement, les juges ont réduit les peines infligées à deux d’entre eux mais ont maintenu celles des deux autres.
