Tout est à refaire pour la municipalité de Port Louis. L’Independent Review Panel (IRP) a annulé un contrat de gardiennage de Rs 47 millions alloué à Top Security Service Ltd, et ce, après une contestation de la Rapid Security Services Ltd pour un manque de transparence. La compagnie contestait le fait qu’elle ne dispose pas d’un personnel adéquat pour faire ce travail et que les dispositions de la Workers Rights Act n’aient pas été suivie.
« In the light of the above, we annul the decision to award contract to the successful bidder and issue an order prohibiting the city council (and evaluation committees for this procurement for relying, as has been done, on the correspondence dated 21th July 2021 and 4th August from (or on behalf of the commissioner of police. Accordingly, we also remit the matter back to the City Council for re-evaluation or for any any other action, it deems fit in circumstances », note l’IRP dans ses Findings.
Cette instance souligne également qu’au cas où un exercice d’évaluation est considéré, il faudrait aussi inviter le comité d’évaluation à prendre en considération les points soulevés par la compagnie contestatrice. « On a final note, we feel it necessary to express our appreciation for the board work done by the BEC members in these procurement proceedings and we acknowledge that they and the CPB have done their level best to try and repair the damage flowing from the inconsiderate acts of three or four bidders, acts which have led to a waste of public monies as well as the time and efforts of public official at the council and the CPB. So much for the client is king », souligne l’IRP.
L’exercice d’appel d’offres avait été lancé le 15 avril dernier. À la suite de quoi cinq soumissionnaires s’étaient fait connaître. Après examen des offres, le comité d’évaluation du CPB devait soumettre ses observations à la municipalité de Port-Louis pour faire son choix.
La mairie avait porté son choix sur Top Security Service Ltd. Au sujet du nombre de gardiens de sécurité nécessaires, l’IRP souligne qu’aucun soumissionnaire n’a de permis pour 100 gardiens. « It is apparent from the table that none of the bidders had 100 employees licenced under their company names. It is of note that the successful bidder had applied for number far lower than 100 and had, by then, been issued that number already, and had a chance of breaching the 100 minimum », dit l’IRP.
